In 2019, the Black Parallel School Board (BPSB) filed a lawsuit against the Sacramento Unified School District alleging segregation of special education students and other exclusionary practices, disproportionately impacting students with disabilities and black student with disabilities.
Independent Monitor’s Duties
The Independent Monitor (IM) is responsible for developing and implementation of an action plan to achieve the 22 directives outlined in the 2023 Settlement Agreement. The key duties include:
Create a Data-Driven Action Plan for Systems Change: The IM is responsible for developing an Action Plan including steps intended to achieve the outcomes outlined in the settlement agreement and reasonable timelines.
Data Collection: Develop a reliable data collection system and establish baseline metrics to guide the development of an action plan targets.
Evaluating Disciplinary Practices: Assess the district's disciplinary practices, including in-school and out-of-school removals, informal suspensions, use of restraints, and referrals to law enforcement and campus security officers (CSOs). This evaluation will focus on identifying any adverse impacts on students with disabilities and Black students with disabilities and guide the development of an action plan to reduce disciplinary referrals.
Policy Reform: The IM is responsible for overseeing the review and revision of policies, procedures and practices related to the various areas of the agreement settlement.
